On November 30, 2017, Lucinda Small, a phlebotomist, filed a collective action against Vista Clinical Diagnostics, LLC, (“Vista”), a clinical laboratory company headquartered in Clermont, Florida, on behalf of Phlebotomists who work for Vista. While employed by Vista, Ms. Small regularly worked approximately 56 hours per week and was paid a piece rate for each blood draw. Ms. Small’s complaint alleges that Vista misclassified Phlebotomists as independent contractors and failed to pay them overtime wages when they worked more than 40 hours in a workweek. Ms. Small, individually and on behalf of other Phlebotomists, seeks to recover unpaid wages from Vista for overtime work, liquidated damages, attorneys’ fees and costs, and be appointed the lead Plaintiff for the FLSA Collective Class.
