The Claims in the Lawsuit

The Complaint alleges that the hourly-paid, non-exempt store employees of Defendants regularly worked over forty (40) hours per week but did not receive compensation for all hours worked due to Defendants’ common unlawful policies of deterring workers from recording time worked in excess of their scheduled hours and altering workers’ time records to reduce the number of hours for which they are paid. The Complaint further alleges that Defendants’ hourly-paid, non-exempt store employees routinely worked hours in excess of forty (40) in a workweek, but were not paid any overtime compensation, in violation of the federal labor laws – Fair Labor Standards Act (“FLSA”), 29 U.S.C. § 201, et seq.

Until the Consent to Sue form is filed with the Court, the statute of limitations ordinarily continues to run.
