FirstSource Solutions USA provides eligibility, enrollment, and other recovery services for hospitals and health systems.

The Employees

Position(s): Patient Service Representatives, Floaters/Trainers, and/or Team Leads employed by Defendant.

The Claims in the Lawsuit

The complaint alleges that FirstSource Solutions USA violated the Fair Labor Standards Act by:

Failing to compensate employees including Patient Service Representatives, Floaters/Trainers and Team Leads for off-the-clock work performed pre-shift, post-shift, and during lunch breaks.

Prohibiting these employees from reporting or clocking in more than forty (40) hours of work per week.

Failing to pay their Patient Service Representatives, Floaters/Trainers, and/or Team Leads for all hours worked in excess of forty (40) in a workweek.

Case Status

October 4, 2017: A Collective Action Complaint was filed in the United States District Court for the Western District of Kentucky. The case has been reassigned to Judge Rebecca G. Jennings.

September 12, 2019: The Court conditionally certified this lawsuit as an FLSA Collective Action on behalf of all current and former Patient Service Representatives, Floaters/Trainers, and/or Team Leads in the Durham, North Carolina and Birmingham, Alabama regions.

October 16, 2019: A Court-approved Notice was disseminated by claims administrator to over 600 putative members of the collective consisting of all current and former Patient Service Representatives, Floaters/Trainers, and/or Team Leads employed by FirstSource Solutions USA in the Durham, North Carolina and Birmingham, Alabama regions at any time from September 12, 2016 through present.

Potential opt-in Plaintiffs have sixty (60) days from the date the notice is mailed to return their completed consent forms.

To participate in this lawsuit, the completed consent forms must be postmarked by December 16, 2019.
